1994

- March 9, 1994 10 year old girl (Cristin Fitzpatrick) of Scarbourough, Greater Toronto, Canada drowned after a pool's filtration system entrapped her hair forcing her underwater.

- June 1994 15 year old child drowned in municipal pool located in Nante, France when her chest is sucked against the bottom drain.  Witnesses were unable to disengage the child.  The local fire department was called.  it took them a quarter hour to free the victim

- June 1994 14 year old boy sucked into pool drain in a public pool located in Saint-Branchs (Indre-et-Loire), France.  A lifeguard was able to release the boy and revive him by mouth to mouth resuscitation.

- July 17, 1994  10 year old girl has her hair sucked into a pool drain, and is saved only by the quick thinking of bystanders.

- November, 1994,  Doctors Hultman CS, and Morgan R, of the Department of General Surgery, University of North Carolina School of Medicine, report in their article " Transanal intestinal evisceration following suction from an uncovered swimming pool drain" Trauma, 37(5):843-7, concerning an 8th documented case of a swimming pool drain causing intestinal evisceration through transanal suction.

1995

- April 1, 1995, a teenage boy is sucked through a sea water circulation pipe in St. Malo, France.  Ten minutes later, in the same pool, a 32 year old instructor is sucked up against the same intake.  He is eventually released, but falls into a coma.

- April 4, 1995 the newspaper Ouest France reports investigation has shown that, as of April 4, 1995, there have been 11 cases of suction entrapment incidents in France: 7 of which were fatal.

- September 5, 1998, 11 year old girl (Kelsey L. Ruwe) sucked into pool drain in Kansas City, MO, dies of drowning

- July 4, 1999,  11 year old boy is sucked against a pool drain at a residence hotel in Maeva de Meribel Les Allues, France  Following release, the boy dies during transport to the hospital in Moutiers.

- May 26, 2000, 8 year old boy sucked into middle school pool drain and drowned in Hollywood, FL

- August 22, 2000, 10 year old boy (Jordon Edward Bucy) drowned after his fingers became entrapped in suction drain of his family's Ocala, Florida, home whirpool spa

- July 19, 2000, 11 year old girl (Nicole Rodriguez) dies of drowning in neighbor’s pool in West Kendall, Miami, FL after hair becomes entrapped in drain located on pool wall.

+ Estate of Chad Humphreys v. Sun International Hotels, Ltd., Case No. 00-3741 (US Dist. Ct., So. Dist., Miami, 2001).  12 year old Miami area boy sucked into drain pipe in Paradise Lagoon at Atlantis Resorts, Nassau, and killed.

- “2000 was a very sad year for the families of four Florida children.  One family lost their child as a result of hair entanglement; the other three children were limb entrapped.  Two of those children died.  The other child lived, although he remains in a coma.”

2001

 - August, 2001,  a young french girl is eviscerated and killed in a pool operated by the Club Athenia, Greece. A non-automatic pump stop device was located near the pool but never put into use during the incident.

- August,  doctors Gomez-Juarez M, Cascales P, et al, Department of general Surgery, Albacete General Hospital, Albacete, Spain report on evisceration incident in their article "Complete evisceration of the small intestine through perianal wound as a result of suction at wading pool" Trauma, 51(2):398-9.

- September,  13 year old boy (Michael Bothelho) sucked into condominium hot tub drain.  Drowns.

2002

+ Baker v. Poolservice Company, 636 S.E. 2nd 360 (VA 2003)

Injuries:

7 year old girl trapped in spa drain, dies same day.

Judgments/Settlements:

Poolservice Repair Company, who merely worked on existing pump, found not liable.  This case, however, resulted in the later passage of the Virginia Graeme Baker Pool and Safety Act.

1985 to 2002

Consumer Protection Safety Commission (CPSC) reports at least 147 drain entrapment incidents: 51 involved hair entanglement; 79 limb entrapments; 3 eviscerations; 4 mechanical; and 13 unknown.  36 of 147 incidents were fatal.  [NOTE:  The CPSC acknowledges that drain entrapment incidents are under-reported]

2004

- July, 2004, 8 year old girl (Haven Scarborough) drowns in spa in Elk Grove, Sacramento, CA

- August 2, 2004, 10 year old girl (Katie Galvinic) survives near drowning in spa when hair is sucked into drain in Huntington Harbour, CA

2005

Consumer Product Safety Commission (CPSC) analysis finds that the typical age of children suffering eviscerations from pool drain incidents is 2 to 6 years, and that victims of hair entanglement in pool drains range from 4 to 42 years of age, 92.5% of which are under the age of 15.

2006

- Teen from Newark, NJ hospitalized for one week after being sucked into drain in Kissimmee, FL facility [The Associated Press, July 2006]

- July, 2006,  11 year old boy (Brendan Chernin) pinned by chest to hot tub drain in West Palm Beach, FL.  Hospitalized 11 days.

- July 26, 2006,  3 year old boy (Ryan Kotschedoff), disembowled in spa.  In intesive care for four days.

- August 1, 2006,  7 year old girl in Fujimono Municipal Swimming Pool sucked into inlet and killed.

- 7 year-old (Erika Tomanu) died when she was sucked head first 30 feet down the intake pipe located in a current pool at a water park in Saitama, Japan. Despite of the grille not covering the inlet when it came off, lifeguards considered the pool safe to swim. It took 6 hours for the rescuers to recover the little girl's body.

- March 29, 2008,  2 year old Naples, Florida boy's arm sucked into wading pool vacuum line.  Firefighters drain pool while toddler's nanny holds his head above water.  Following over two hours of work with an air chisel and circular saw the child's arm is finally released.

- July 16, 2008,  4 year old girl’s (Rose Schmidt-Crizier) arm sucked into pool drain in Southwest Miami, Dade County, FL.  Saved by her mother. administering CPR after near drowning.

- Consumer Product Safety Commission ("CPSC") 2013 Report concerning "Circulation/Suction Entrapments Assocaited with Pools, Spas, and Whirlpool Bathtubs" having taken place between 2008-2012 lists 7 additional incidents (not identified as to vicitim name or location), as having occurred in 2008.  One of these involved a fatal evisceration/diembowlment of a six year old female in a pool.

+ Williams v. Downtown Athletic Club of Pittsburgh, Case No.: _____ (Common Pleas Ct., Allegheny Co., PA  2009)

Injuries:

38 year old Lorenzo Williams drowned 10’ deep pool which was clearly not complaint with the Virginia Graeme Baker Pool and Spa Safety Act.  Pool owners claim they were "unaware' of the VGBPSA requirements.  Litigation continues.

- June 13, 2009,  Gainsville Sun reports that 15 year old teenager nearly drowned after being trapped under water at the bottom of a pool by its drain.

- June 26, 2009,  Houston 2 News reports that a teen, Diego Soto, escaped drowning only when his friends were able to render CPR on the spot, after he had been sucked into a drain located in the side of a pool.

- Summer 2009,  3 year old boy (Hassan Itani) drowned after being sucked under water by drain at Kalahari Waterpark, Ohio.

- July, 2009,  Pool Safety Council reports two near-fatal suction entrapment incidents in one week. The first involving a 5 year old boy from Pembroke Pines, Florida who nearly drowned; the second involving a young girl, Tambara Walton, who was entrapped by her inner thigh on a side drain of a pool in a water park outside Houston, Texas.

-July 13, 2009,  Mail Online reports that 14 year old british teen (Nathan Clark) sucked into bottom drain of Pattaya Water Park, Thailand, after having dived down to find his swim goggles.

- August 24, 2009,  3 year old girl entrapped in vacuum intake line in Key Colony Condominium, Key Biscayne, Florida.  Firefighters take several hours to relase the child and are only able to do so by breaking up the pool concrete.  The pool was built in 1980, served a condominium project of more than 32 units, and was permitted but had been "exempted" from certain inspections by the Miami-Dade County Health Department pursuant to Florida Statute 514.112(b) [now FS Section 514.0115(2)(b)] on 8/5/96.

- Consumer Products safety Commission ("CPSC") 2013 Report concerning "Circulation/Suction Entrapments Associated with Pools, Spas, and Whirlpool Bathtubs" having taken place in 2008-2013, lists 7 additional incidents (not identified by victim name or location), in Appendix "B" as having occurred in 2009.  Six out of seven of these incidents involved personal injury.

2011

- Consumer Products Safety Commission (CPSC) reports that from the 1999-2010 period, CPSC staff was made aware of 97 circulation entrapments in pools and spas.  Of these entrapments: 85% resulted in injury; 12% in death; 3% no injury.  79% of the entrapments involved individuals younger than 18 years of age.

-  May 2012, Consumer Products Safety Commission (CPSC) issues it 2012 Report concerning "Reported Circulation/Suction Entrapments Associated with Pools, Spas and Whirlpool Bathtubs".  This Report reflects a substantial INCREASE IN REPORTED INCIDENTS, from a total of 3 in 2010 to a total of 9 in 2011.

- July 9 2012, 

- May 28, 2012, CPSC  deadline for bringing single drain pools/spas into compliance with the federally mandated Virginia Graeme Baker Pool Spa and Safety Act ["VGBPSA"] expires.

-  June 2012, 4-year-old, Kayleb Santiago's, arm gets sucked into vacuum intake at the Country Club Apartments located near Courtney parkway on Merritt Island, in Florida.  Firefighters work 90 minutes to extract her from this potenitally life-threatening situation.  The Apartment Manager's reported response to the incident is typical: He had 'not received any complaints' (apartment residents advise otherwise), 'the cap was not on but it was not our doing', he 'believes the [little girl] was trespassing'.

-  July 9, 2012, 4 year old girl injured when her bottom sucked onto pool drain at Langford Farms Swim Club, Old Hickory, Tennessee.  Preliminary investigation reflects that drain cover was not properly in place.  Tennessee Department of Health and Federal Consumer Product Safety Commission ["CPSC"] investigations are ongoing.

- November 14, 2012, 31 year old woman lounging in 6-inch-deep water becomes entrapped in drain cover at Greeley Family Funplex.  Local fire department has to remove drain cover with the woman still attached.

-  Consumer Products Safety Commission ("CPSC") 2013 Report concerning "Circulation/Suction Entrapments Associated with Pools, Spas, and Whirlpool Bathtubs" having taken place between 2008-2012 lists an additional 5 incidents (not identified as to victim name or location) as having occurred in 2012. Four out of the five incidents involved personal injury, one of these being classified as an "Eviscerate/Disembowl" type entrapment.

2013

- March 19  Consumer Products Safety Commission ("CPSC") issues its 2013 Report concerning "2008-2012 Reported Circulation Entrapments Associated with Pools, Spas, and Whirlpool Bathtubs".  "Figure 1" of the Report reflects a stabaliztion of incidents in the United States at between 8 to 10 per year, and evidences that when these events occur they most frequently result in bodily injury or death.  "Appendix B" of the Report provides a case-by-case Summary of the incidents covered (with location and victim identity redacted).

-  August 5  5 year old son (Usher Raymond V) of R&B Singer, Usher, is sucked into the pool drain at his father's home in Atlanta and barely survives drowning.  According to news reports, the 5 year old boy dove into the pool to retrieve a toy.  The efforts of three bystanders were needed to finally retrieve the child from the drain, whereupon CPR was administered and his life saved.

2014

- 30 May  A four year old boy is drowned in a "Spa Pool" in his grandparents' backyard when his hand is sucked into its suction drain inlet.  Despite his grandfather's best efforts, the boy could not be pulled from the drain before he drowned.  As in many such cases, the drain cover, although located in the bottom of the pool, was not over the inlet.  No reason was given for how the drain cover became unfastened.
